Uttar Pradesh Real Estate Regulatory Authority has issued the 11th Amendment to the UP RERA (General) Regulations, 2019, covering Regulation 3(a), Regulation 53, and Regulation 54.

Regulation 3(a): Form-REG-3 for the Chartered Accountant’s certificate is substituted by a revised Form-REG-3. The revised form is submitted at the time of Project Registration, Withdrawal of Money from Separate Account, and Submission of Quarterly Progress Report. It comprises Part-A (project cost details covering Land Cost, Project Clearance Fees, and Construction and Development Cost) and Part-B (amounts payable to vendors/contractors/allottees), and requires CA certification with Firm Registration Number and UDIN.

Regulation 53: Clause-(d) is substituted by: “Real Estate Project (Maintenance and Operation of Project Bank Accounts) Directions, 2020 as revised by the Authority from time to time shall be part of these regulations.”

Regulation 54: Title revised to “The Real Estate Agent Enrolment, Training, Certification and Statutory Compliances.” Three new clauses inserted:

(d) Every registered real estate agent shall maintain Cash Book, Journals, Ledger, and Customer Register in Form REG-8, preserved for a minimum of five years from project completion or registered sale/lease deed.

(e) Every registered real estate agent shall submit quarterly updates of transactions and employee details in Form REG-9 within 15 days from end of quarter. Late fee of ₹10,000 payable for delay.

(f) At first statutory filing, the agent shall provide details of all transactions since registration; in every subsequent filing, details of the current quarter only.

Two new forms introduced: Form REG-8 (Customer Register of Real Estate Transactions) and Form REG-9 (Quarterly Submission of Real Estate Transactions comprising Tables for project affiliation, transaction details, employee details, and a nine-point declaration).
