Notifications under Code on Social Security, 2020 – Designations, Exemptions and Schemes

Notification/Circular No. S.O. 2343(E), 2344(E), 2351(E), 2352(E) and 2355(E) dated May 08, 2026
Applicable Act/Rule: Code on Social Security, 2020 (36 of 2020)

Ministry of Labour and Employment issued five notifications on May 8, 2026 under the Code on Social Security, 2020, as follows:

S.O. 2343(E) | Section 140(2)(b): The Central Government has notified that the provisions of section 139 of the Code shall not apply in relation to vacancies which carry a total remuneration (wages as defined in the said Code) of less than rupees eleven thousand per month. S.O. 2344(E) | Section 2(30): The Central Government has notified that the Joint Director (Employment) or the Director (Employment) looking after the work of Career Centre (Central) in the Directorate General of Employment, Ministry of Labour and Employment, Government of India, shall be the executive officer for the purposes of Chapter XIII of the said Code to discharge the duties under that Chapter. S.O. 2351(E) | Section 2(26) first proviso: The Central Government has specified that an employee whose wages exceed, at any time after and not before the beginning of the contribution period, the wage ceiling as may be notified by the Central Government under clause (89) of section 2 of the Code for the purposes of becoming a member under Chapter IV, shall continue to be an employee for the remainder of that contribution period. S.O. 2352(E) | Section 2(44) proviso: The Central Government has notified the following classes of medical practitioners, having specified qualifications, as medical practitioners for the purposes of Chapter IV of the Code and for provisions in the Code relating to that Chapter — persons possessing a recognised medical qualification and registered with: (a) the National Medical Commission or any State Medical Council constituted under the National Medical Commission Act, 2019 (30 of 2019); or (b) the National Commission for Indian System of Medicine or an Autonomous Board or State Medical Council of Indian System of Medicine under the National Commission for Indian System of Medicine Act, 2020 (14 of 2020); or (c) the National Commission for Homoeopathy or an Autonomous Board or State Medical Council of Homoeopathy under the National Commission for Homoeopathy Act, 2020 (15 of 2020). S.O. 2355(E) | Section 44: The Central Government has framed the Other Beneficiaries and Members of Their Families Medical Facilities Scheme, 2026, effective from the date of its publication in the Official Gazette. The Scheme applies to other beneficiaries and members of their families registered under any scheme, other than the Employees’ State Insurance Scheme, framed by the Central Government. The key provisions of the Scheme are as follows:

  • Registration: A person desirous of availing medical treatment and attendance shall fill a registration form electronically or otherwise with particulars as specified by the Employees’ State Insurance Corporation (Corporation), and produce the identity card issued by the Corporation or under any other scheme framed by the Central Government.
  • Benefits: Persons registered under the Scheme shall be provided medical treatment and attendance from under-utilised Employees’ State Insurance Hospitals.
  • User Charges: Persons availing treatment shall pay user charges at rates notified by the Corporation in consultation with the Central Government. User charges collected shall be deemed to be contribution and shall form part of the Employees’ State Insurance Fund.
  • Time and Manner: The time and manner of availing facilities shall be as specified by the Corporation from time to time.
  • Records: Concerned hospitals shall maintain separate electronic registers and records of beneficiaries and user charges collected, in such form and manner as specified by the Corporation.
