Ministry of Communications (Department of Telecommunications) has notified two sets of rules published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i). Both are issued under identical parent Acts and follow an identical rule structure covering licensing exemption, technical parameters, equipment type approval, standards compliance, and interference management. Manufacturers, dealers, and users of the covered equipment installed on vehicles are impacted.

Notwithstanding the Indian Wireless Telegraphy (Possession) Rules, 1965, and subject to conditions in sub-rules (2) to (5) of rule 4 in each notification, the establishment, maintenance, or working of an On Board Unit in the 5875-5905 MHz band (G.S.R. 466(E)) and a Short-Range Automotive Radar System in the 77-81 GHz band (G.S.R. 468(E)), both installed on vehicles, shall be permitted without assignment of radio frequency, on non-interference, non-protection, and non-exclusive basis. No licence shall be required for possession, sale, or hire of either equipment.

The technical parameters prescribed are: for the On Board Unit — maximum power spectral density EIRP 23 dBm/MHz, maximum EIRP 33 dBm, out-of-band emissions -30 dBm/MHz; for the Short-Range Automotive Radar System — maximum average EIRP 50 dBm, maximum peak EIRP 55 dBm, maximum emission bandwidth 4 GHz, maximum unwanted emissions -30 dBm/MHz.

Equipment type approval shall be sought via application on the DoT portal for each equipment type; no application is required where approval has previously been accorded and published on the portal. Both equipment types shall conform to standards notified by the Bureau of Indian Standards or the Central Government, or to relevant international standards where domestic standards are not published. On receipt of information of harmful interference to a licensed system, the Central Government or an authorised officer may direct the user of the exempted equipment to carry out remedial measures within a specified timeframe.
