Exemption of Shops&Commercial Establishments from Weekly Rest&Working Hours Provision in Rajasthan

In exercise of the powers conferred by sub-section (2) of section 3 of the Rajasthan Shops and Commercial Establishments Act, 1958, and in supersession of notification No. F.14(11)(1) Shram/Vidhi/2017/4863577 dated April 15, 2024, the State Government exempts shops and commercial establishments registered under the said Act from the provisions of sub-section (1) of section 11 and sub-section (1) of section 12 of the said Act, with immediate effect, subject to the following conditions:

  1. One day’s paid weekly rest shall be given by the employer to all employees, in rotation
  2. The working hours of employees shall not be more than ten hours per day and forty eight hours in a week. In case extra work is taken from the employees, record of the same shall be maintained separately by the employer
  3. If overtime work taken from any employee, he shall be paid according to the provisions of the law
  4. Appointment letter shall be given by the employer to all the employees. The copy such appointment letter shall be sent to the Labour Inspector of the area concerned and the acknowledgement shall be kept in the record by the employer
  5. The employees of such Shops and Commercial Establishments shall continue to be benefited of all the provisions of the said Act
  6. Such exemption shall be subject to the compliance of the above conditions and the orders issued by the State Government, from time to time, by the employer and
  7. In case of violation of any of above condition by the employer, the exemption shall deemed to have been revoked automatically and the employer shall be liable for legal action under the provisions of the said Act and other relevant laws.
