Gujarat Pollution Control Board Issues Closure Directions against industrial units for violation of various environmental laws. Industrial units apply online, along with required documents, for revocation of such closure orders, and the applications are scrutinized by the Board’s Regional Offices. Until now, documents were accepted as per Form No. D7 (Application for revocation of closure order), referenced against a format prescribed under Reference No. 1 and an office order dated 09/11/2023 referenced as Reference No. 2.

With the objective of simplifying the revocation process, the circulars referenced at Reference No. 1 and 2 are withdrawn, and applicants are now required to upload the following documents on the Board’s XGN 2.0 portal for revocation applications:

• a Compliance Report, self-certified on company letterhead by an authorized person, covering point-wise compliance against the reasons and directions stated in the closure order, along with supporting evidence (a format for this is enclosed).
• a letter regarding disconnection of electricity supply by the concerned power company, if applicable.
• a Bank Guarantee from a scheduled bank of the state, as per the Board’s prevailing bank guarantee policy.
• where a unit does not have CTE and CCA and intends to operate the plant at the time of filing the revocation application, an application for CTE and CCA on the XGN 2.0 portal, with the revocation application to be decided after CTE approval.
• where a unit does not intend to operate the plant, dismantling of the plant on-site with photographs and the above documents, or an application for revocation with a time limit for dismantling and
• where the closure direction was issued due to an accident, documents including intimation and implementation details received from DISH (if applicable), details of quantity regarding safe environmental disposal of burnt material or waste (if applicable), and PLI Policy (if applicable).
