Chhattisgarh Real Estate Regulatory Authority (CGRERA) has issued Circular No. 148 in reference to Circular No. 138 previously issued by the Authority. Circular No. 138 had specified that the NOC (consent/objection certificate) of two-thirds (2/3) allottees is required to be submitted only in those cases where the Authority has imposed it as an Additional Condition at the time of granting project extension, or where it has been expected along with other requirements. The present circular prescribes the format (Annexure-A) in which such NOC is to be submitted.
In all cases where the Authority has required submission of NOC from two-thirds allottees, the NOC shall be submitted only in the prescribed format Annexure-A enclosed with this circular. The circular is applicable with immediate effect.
Annexure-A — Informed Consent Letter of Allottees (2/3) for Extension of Project Registration Period is prescribed as follows:
The form captures the following details: Project Name, Registration Number, Promoter Name, Original Registration Validity/Project Completion Date, Proposed Extended Registration Period, and Declaration and Consent by allottees.
The body of the consent letter states that the undersigned allottees, being holders of unit/bungalow/plot in the project, declare that: the promoter has provided information regarding the current status of the project, reasons for extension, pending development works, common areas, infrastructure and amenities to be provided, details of which are mentioned in Annexure-1 attached; the allottees clearly understand and accept that the proposed extension of the project’s registration period is only for completion of the remaining development works of the project; and the extension of registration of the project shall in no case affect the possession date mentioned in the agreement between the promoter and the allottee.
Annexure-1 (attached to the consent letter) requires the following details of the project’s current status and extension: (1) Original Registration Validity/Completion Date; (2) Extended Period Sought; (3) Reason for Extension; (4) Details of Remaining Development Works; (5) Total Number of Units/Plots; (6) Total Number of Units/Plots Sold; (7) Total Number of Allottees; (8) Number Required for Two-Thirds Consent; (9) Number of Allottees Providing Consent.
An important note states that the extended registration period of the project shall not be considered as a new possession date for individual unit/plot/bungalow. The extension is only for completion of remaining development works and common amenities of the project.
