Applicable Act/Rule: Pharmacy Act, 1948 (proposed to be repealed); National Pharmacy Commission Bill, 2026 (draft, not yet enacted)
Ministry of Health and Family Welfare has stated that it proposes to finalize the National Pharmacy Commission Bill, 2026, for setting up the National Pharmacy Commission (NPC) and for repealing the Pharmacy Act, 1948. A second version of the draft National Pharmacy Commission Bill has been prepared by the Ministry and is attached to the notice for comments of the General Public and Stakeholders.
The notice states that comments on the second draft version of the Bill may be furnished within one month from the date of publication of the notice. Comments may be sent by e-mail to so.ahssecn-mohfw@gov.in, or by post to Shri Santosh Kumar, Under Secretary (AHS), Kartavya Bhawan-1, 1st Floor, A-Wing, New Delhi, with the subject line “Comments/suggestions on NPC Bill, 2026.” The notice is signed by Santosh Kumar, Under Secretary to the Government of India. The draft Bill text runs to 59 sections across 11 chapters covering constitution of the Commission, its Boards, State Pharmacy Councils, registration, recognition of qualifications, the Pharmacy Advisory Council, grants/audit, powers of the Central Government and Commission, and repeal and transitional provisions relating to the Pharmacy Act, 1948 and the Pharmacy Council of India.
