Draft Rules under the Four Labour Codes in the State of West Bengal

All four sets of draft rules were issued by the Government of West Bengal, Labour Department, New Secretariat Buildings, Kolkata, on 13-07-2026, in exercise of rule-making powers under the respective Central Codes, in supersession of all existing rules, orders, and notifications on the subject. Each notification invites objections and suggestions to be sent to the Secretary, Labour Department, via dedicated email IDs (labourcode.wages.ruleswb@gmail.com; labourcode.ir.ruleswb@gmail.com; labourcode.ss.ruleswb@gmail.com; labourcode.osh.ruleswb@gmail.com respectively), in a proforma specifying (i) name and address of the person/organization, (ii) the rule or sub-rule proposed to be modified, and (iii) the revised rule or sub-rule proposed along with reasons. Each draft will be taken into consideration after expiry of forty-five days from the date of publication of the respective notification in the Official Gazette.

  • West Bengal Code on Wages Rules, 2026 (21 pages, 9 chapters): covers minimum wage calculation, dearness allowance revision, normal working day and weekly rest, payment of wages to contractual employees, deductions for loans, the State Advisory Board, payment of undisbursed dues/claims, forms/registers/wage slips, Inspector-cum-Facilitator powers, and offences and penalties, along with miscellaneous provisions such as payment of bonus to contractual employees.
  • West Bengal Industrial Relations Rules, 2026 (68 pages, 13 chapters): covers Bi-partite Forums (Works Committees), Trade Union registration/subscription/appeals, Standing Orders, Notice of Change, voluntary reference of disputes to arbitration, the Industrial Tribunal and dispute-resolution mechanism, strikes and lock-outs, lay-off/retrenchment/closure, special provisions for certain establishments, the Worker Re-Skilling Fund, offences and penalties, and miscellaneous provisions including protected workers.
  • West Bengal Social Security Rules, 2026 (86 pages, 13 chapters): covers the West Bengal Unorganised Workers Social Security Board and Building and Other Construction Workers’ Welfare Board, the Employees’ Insurance Court, gratuity (nomination, application, competent authority, recovery), maternity benefit complaints and appeals, employee’s compensation (including funeral expenses), cess on building and construction workers, finance and accounts, authorities/assessment/compliance, offences and penalties, employment information and career centres, and miscellaneous provisions.
  • West Bengal Occupational Safety, Health and Working Conditions Rules, 2026 (255 pages, 14 chapters): covers establishment registration, the State Occupational Safety and Health Advisory Board, safety officer duties and qualifications, hours of work and annual leave with wages, maintenance of registers/records/returns, Inspector-cum-Facilitator and other authorities, special provisions relating to employment of women, contract labour
