Draft Rules under the Four Labour Codes (UT of Dadra & Nagar Haveli and Daman & Diu)

All four sets of draft rules were issued by the UT Administration of Dadra and Nagar Haveli and Daman and Diu, Department of Labour & Employment, Daman, on 20-07-2026, following enactment of the respective Central Codes by Parliament. Draft rules under each Code were earlier placed on the Official Website in 2023 inviting objections (Wages: Notification dated 24-11-2023 No. …/568; IR: No. …/569; OSH&WC: No. …/566; Social Security: No. …/567). All provisions of the four Codes have since been brought into force via various S.O. notifications published in the Gazette of India between 2021 and 2025. The Administrator now proposes to make final rules under each Code in supersession of the corresponding pre-existing state/UT rules (e.g., the Minimum Wages Rules 1970/1975, Payment of Wages Rules 1964/1977, Trade Union Regulations 1986/2010, Factories Rules 1971/1985, Contract Labour Rules 1972/1976, Workmen’s Compensation Rules 1965/1977, Maternity Benefit Rules 1967, Payment of Gratuity Rules 1973/1985, and related instruments), except as respects things done or omitted before supersession.

Each notification is issued under the corresponding statutory provision for information of persons likely to be affected. The draft notifications will be taken into consideration after expiry of forty-five days from the date copies of the Official Gazette are made available to the public. Objections/suggestions for all four may be addressed to the Commissioner-cum-Secretary (Labour), DNH & DD, Secretariat, Vidhyut Bhawan, Kachigam, Nani Daman – 396 210, or by email to secy-labour-dd@ddd.gov.in or lelidaman@gmail.com, in the prescribed proforma.

  • Code on Wages Rules, 2026 (52 pages, 10 chapters, Forms I–IX, Schedule A): covers minimum wage calculation and fixation, technical committee for skill categorization, working hours, weekly rest, payment of wages, deductions, bonus set-on/set-off, State Advisory Board, payment of dues/claims, registers/wage slips/returns, Inspector-cum-Facilitator powers, and offences/penalties. Schedule A categorizes occupations as unskilled, semi-skilled, skilled, and highly skilled.
  • Industrial Relations Rules, 2026 (58 pages, 13 chapters, Forms I–XVIII plus Forms 17–20): covers Works Committees, Grievance Redressal Committees, Trade Union registration/funds/audit, negotiating union/council recognition and verification by secret ballot, Standing Orders, Notice of Change, voluntary arbitration, Industrial Tribunal composition, conciliation and adjudication procedure, strikes/lock-outs, lay-off/retrenchment/closure, Worker Re-skilling Fund, and offences/penalties.
  • OSH&WC Rules, 2026 (271 pages, at least 84 rules reviewed, with an extensive Schedule of hazardous/toxic substances and multiple Forms): covers competent person recognition, establishment registration and fees, duties of employers (medical examination, appointment letters, accident/dangerous occurrence/disease notice), the Occupational Safety and Health Advisory Board, Safety Committees and Safety Officers, hours of work and leave, registers/records/returns, Inspector-cum-Facilitator powers, special provisions for women employees, contract labour and inter-State migrant workers, audio-visual workers, and beedi and cigar workers.
  • Social Security Rules, 2026 (57 pages, 13 chapters, Forms I–XXV): covers the Unorganized Workers Social Security Board and Building and Other Construction Workers’ Welfare Board, Employees’ Insurance Court procedure, gratuity (nomination, application, payment, competent authority, appeals, recovery), maternity benefit complaints and appeals, employee’s compensation, cess on building and construction workers, finance and accounts, records/registers/returns, offences and compounding, and employment information and monitoring (Career Centres, vacancy reporting).
