Draft Telecommunications (Spectrum Assignment by Administrative Process) Rules, 2026

Ministry of Communications (Department of Telecommunications) published the draft Telecommunications (Spectrum Assignment by Administrative Process) Rules, 2026 for public information and invited objections or suggestions within thirty days from the date the notification is made available to the public.

Draft rules prescribe the terms and conditions for assignment of spectrum through administrative process for entries specified in the First Schedule to the Telecommunications Act, 2023. The rules provide eligibility conditions, application procedure, issuance of letter of intent, grant of spectrum assignment, spectrum charges, renewal, surrender, modification of assignment, disposal of radio equipment, digital implementation and breach-related provisions. The rules also specify eligible entities and permitted spectrum uses for sectors including national security, law enforcement, public broadcasting, disaster management, scientific research, transport systems, conservation of natural resources, weather forecasting, mining, ports, oil exploration and public mobile radio trunking services.

“These rules may be called the Telecommunications (Spectrum Assignment by Administrative Process) Rules, 2026.
(2) They shall come into force on such date as the Central Government may specify by notification in the Official Gazette.”
