Extension of Validity of Registration and Completion Timelines of Real Estate Projects

U.P. Real Estate Regulatory Authority issued directions concerning extension of the validity of registration and corresponding completion timelines of registered real estate projects in the context of the Ministry of Housing & Urban Affairs, Government of India, Office Memorandum No. 17024/66/2018-HOUSING UD/E-9042100 dated July 31, 2026, relating to delay attributed to Force Majeure conditions arising from the prevailing West Asia situation.

The registration of real estate projects whose completion date, revised completion date, or extended completion date falls between February 28, 2026 and October 31, 2026, both dates inclusive, shall be extended by four months with effect from the last date of validity of registration. Projects that have already received the Completion Certificate or Occupancy Certificate, as applicable, are not eligible for the extension. The sanctioned map, layout or building plan must be valid and subsisting as on February 28, 2026; the promoter must have filed all Quarterly Progress Reports due up to the last quarter of validity of registration; and the promoter must have submitted the Annual Audit Report (REG-5) for FY 2024-25.

The Technical Division of the Authority shall examine projects meeting the eligibility criteria and verify compliance with the specified conditions before extending the validity of registration. Where the required Quarterly Progress Reports and/or Annual Audit Reports have not been filed, the promoter shall first fulfil the pending compliances and may thereafter submit a request for the four-month extension, which shall be examined by the Technical Division before extension of the registration validity.

The extension applies to the validity of registration and completion timeline recorded with the Authority and does not alter the contractual rights and obligations of promoters and allottees under the Agreement for Sale. The terms of the Agreement for Sale remain unchanged, the possession date stipulated in the Agreement for Sale is not extended or altered on account of the extension, and interest for delay in possession payable by the promoter to the allottee or interest on delayed payments payable by the allottee to the promoter shall continue at the State Bank of India’s Marginal Cost of Lending Rate (MCLR) plus one per cent (MCLR + 1%), as prescribed under the UP RERA Rules.

The directions come into force with immediate effect.
