The rules are made by the Governor of Bihar under Section 67 of the Code on Wages, 2019, in supersession of the Bihar Payment of Wages Rules, 1937 and the Bihar Minimum Wages Rules, 1951. The rules are titled the Code on Wages (Bihar) Rules, 2026, and extend to the whole of Bihar.

The rules prescribe: the manner of calculating minimum wage rates on a day basis using specified criteria (standard working-class family of three consumption units, 2700 calories per consumption unit per day, 66 metres cloth per year, housing at 10% of food/clothing expenditure, fuel/electricity/miscellaneous at 20%, and education/medical/recreation at 25% of minimum wage); norms for fixation of minimum wages by geographical area (metropolitan, non-metropolitan, rural) and skill category (unskilled, semi-skilled, skilled, highly skilled); constitution and functions of the State Advisory Board; hours of work (48 hours/week, with overtime thresholds varying by weekly working pattern, capped at 12 hours spread-over per day and 144 hours overtime per quarter); weekly rest day provisions; procedures for deduction, recovery, and payment of wages, advances, and dues under Sections 18–24; procedures for claims, appeals, and composition of offences under Sections 45, 49 and 56; and prescribed registers and forms (Employee Register, Wage Register, Wage Slip, Attendance Register, and application/appeal/composition forms).
